ISCZ Ski School Terms and Conditions

1. APPLICABILITY

These Terms and Conditions shall exclusively govern the legal relationship between the International Ski Club of Zurich ("ISCZ") and the applicant for the Ski and Snowboard School ("Applicant").

The Applicant shall read these Terms and Conditions carefully prior to starting with the registration process for the Ski and Snowboard School. By applying for a specific Ski and Snowboard School course, the Applicant confirms having read and accepted these Terms and Conditions.

2. REGISTRATION

The number of participants is limited. The Applicant's participation in the Ski and Snowboard School on the date(s) applied for cannot be guaranteed.

The registration is personal, non-transferable and only valid on the date(s) applied for and confirmed by the ISCZ. The registration becomes valid after payment of the registration fee. Prior to such payment no contractual relationship between the ISCZ and the Applicant exists.

The entire registration fee shall be paid prior to the start date of the booked Ski and Snowboard School course.

3. CANCELLATION AND REIMBURSEMENT OF COSTS

For any cancellation by the Applicant provided 14 days prior to the start date of the booked Ski and Snowboard School course, 80% of the registration fee shall be reimbursed by the ISCZ.

For any cancellation by the Applicant provided within 14 days to 6 days prior to the start date of the booked Ski and Snowboard School course, 60% of the registration fee shall be reimbursed by the ISCZ.

For any cancellation by the Applicant provided 5 days or less prior to the start date of the booked Ski and Snowboard School course, the ISCZ shall not be obligated to any reimbursement of the registration fee.

A cancellation of a Ski and Snowboard School course by the Applicant shall not have any impact on the ISCZ membership. Notwithstanding any cancellation the annual membership fee shall be due and the Applicant shall retain his/her ISCZ membership for the full year.

The ISCZ reserves the right to cancel any Ski and Snowboard School course at its own discretion. The ISCZ shall grant full reimbursement of the registration fee in such case.

4. ABSENCE OF COURSES

The ISCZ board committee and/or the School Management of "Schweizer Skischule & Snowboardschule Flumserberg" reserve the final right to exclude the Applicant from the Ski and Snowboard School course irrevocably and without giving any reason. In this case the Applicant shall still be liable for the entire registration fee respectively shall not be entitled to any reimbursement of paid registration fees.

6. INSTRUCTORS AND COURSES

The School Management of "Schweizer Skischule & Snowboardschule Flumserberg" reserves the right to replace a course instructor for parts of or for the entire Ski and Snowboard School course.

Ski and Snowboard School courses shall take place during all weather conditions. The ISCZ reserves the right to cancel any Ski and Snowboard School course in case the ski lifts do not operate. In this case the ISCZ shall grant reimbursement of the registration fee, pro rata per course day cancelled.

7. LIABILITIES

The ISCZ shall not be held responsible for any accidents occurring prior to, during or after the Ski and Snowboard School course. The Applicant is responsible for his/her own accident and liability insurance. With his/her registration to the Ski and Snowboard School course the Applicant confirms having sufficient accident and liability insurance coverage.

The Applicant shall not be entitled to claim any damages, neither in connection with above mentioned accidents nor for damages caused to third parties and/or their property, from the ISCZ and/or from the "Schweizer Skischule & Snowboardschule Flumserberg" respectively its School Management and/or its course instructors.

8. JURISDICTION AND APPLICABLE LAW

These Terms and Conditions are governed by the laws of Switzerland. The exclusive place of jurisdiction is Zurich City.

Missed courses shall not be reimbursed by the ISCZ nor may otherwise be compensated by the Applicant. In particular the Applicant shall not be entitled to catch up the missed courses. 2
